When Machines Mediate Intimacy: Legal Challenges of Emotional AI and Human Relationships

In the contemporary digital ecosystem, Artificial Intelligence (AI) has transcended its traditional computational role to become an emotional intermediary in human relationships. The emergence of Emotional AI—technologies capable of perceiving, interpreting, and simulating human emotions—has fundamentally redefined intimacy, companionship, and communication in the digital sphere. From AI-powered chatbots and virtual companions to therapeutic and caregiving robots, these systems now participate in deeply personal human experiences.
This paper explores the legal and ethical implications of such AI-mediated intimacy through a multi-dimensional lens. It examines the absence of a coherent legal framework governing emotional data, consent, and the psychological manipulation inherent in affective computing. The study evaluates how existing privacy laws, data protection statutes, and constitutional safeguards—such as the right to privacy and human dignity—apply to interactions where emotional expression is algorithmically processed.
Further, the paper interrogates whether emotional AI challenges conventional legal categories of autonomy, personhood, and liability. It highlights global policy gaps by comparing the approaches of jurisdictions like the European Union, Japan, and India, emphasizing the need for a human-centric regulatory model that protects emotional integrity without stifling innovation. Ultimately, the study argues that as machines begin to mediate intimacy, law must evolve to preserve the authenticity of human connection, ensuring that emotion remains a domain of ethical responsibility, not algorithmic exploitation.
